TERMS AND CONDITIONS OF USE
1. Purpose and Acceptance
These Terms and Conditions of Use (the "Terms") govern access to and use of the website www.caddaric.com (the "Site"), edited by Mr. Cédric KLIBER, acting as an independent consultant.
Accessing and browsing the Site, as well as using the services offered (including the contact form and access to protected project dossiers), implies the User's (the "User") full and unconditional acceptance of these Terms. In the event of disagreement with any provision herein, the User undertakes not to use the Site.
Mr. Cédric KLIBER reserves the right to modify these Terms at any time without prior notice. The version applicable is the one published online at the time of use.
2. Access Conditions and Confidential Projects Section
Access to the Site is free and open to any User with an internet connection.
Restricted Access Section:
Certain pages of the Site present conceptual projects and are protected by an authentication system (password). Access to these pages is strictly reserved for qualified investors, institutional partners, or professionals, upon validation by Mr. Cédric KLIBER following a request submitted via the general contact form.
By accessing this restricted section, the User acknowledges and accepts that:
- The information contained therein (concepts, business models, technical architectures, strategies) constitutes trade secrets within the meaning of Directive (EU) 2016/943 and the French Commercial Code.
- This information is the exclusive intellectual property of Mr. Cédric KLIBER.
- The User is strictly prohibited from reproducing, distributing, exploiting, or disclosing this information to any third party, in whole or in part, without prior written consent.
- Any breach of this confidentiality may result in legal proceedings for infringement, unfair competition, and violation of trade secrets, with claims for damages.
Access credentials are personal and non-transferable. The User is responsible for their safekeeping.
3. Contact Form and Nature of Exchanges
The Site features a single contact form for all requests (information, mission inquiries, access to projects).
- Accuracy of Information: The User undertakes to provide accurate and complete information. Mr. KLIBER reserves the right to refuse any request from a fictitious identity or containing erroneous data.
- Nature of Exchanges: Sending a message via the form constitutes a request for contact with a view to negotiations. It does not constitute a firm offer, a contract, or a commitment on the part of Mr. Cédric KLIBER.
- Contract Formation: No contractual relationship (consulting mission, transition management, project sale, or investment) shall be deemed concluded without the prior signature of a written agreement or the formal acceptance of a specific proposal issued by Mr. Cédric KLIBER. Any future invoicing will be issued according to the legal structure chosen by Mr. KLIBER at the time of contract signing.
- Response Time: Mr. KLIBER endeavors to respond to requests within 5 business days. This timeframe is indicative and shall not engage his liability in the event of delay due to exceptional volume or force majeure.
4. Intellectual Property and Prohibitions
The Site and all its content (texts, methodologies, "Caddaric vs AI" analyses, project descriptions, graphics, code) are protected by copyright (French Intellectual Property Code).
The User is strictly prohibited from:
- Reproducing, copying, selling, or reselling any part of the Site.
- Using automated tools (robots, scripts, scrapers) to extract data or content from the Site.
- Using the Site's content to train, feed, or improve artificial intelligence models, machine learning algorithms, or databases without express written authorization from Mr. Cédric KLIBER.
- Attempting to bypass security measures (protected project access).
Any violation of these prohibitions will be prosecuted in accordance with the law.
5. Applicable Law and Jurisdiction
These Terms are governed by French law.
In the event of a dispute relating to the interpretation or execution of these conditions, and failing an amicable resolution, the competent courts shall be those of the place of domicile of Mr. Cédric KLIBER (or failing that, the Judicial Court of Paris), notwithstanding any rule of territorial jurisdiction to the contrary or plurality of defendants.
For any complaint, the User is invited to contact Mr. Cédric KLIBER via the Site's contact form before initiating any legal action, in order to attempt an amicable resolution.
